  • You were not trespassing or committing another crime.
  • You were not teasing, tormenting or abusing the dog.

The law applies whether the attack occurred on or off of the owner’s property or whether the dog was leashed or unleashed. Massachusetts law requires all dogs to be on a leash when not on their property, and they must be under control when they’re not in their house or fenced in by a yard. Massachusetts law does not ban any dog based on the perceived dangerousness of its breed.
