Massachusetts no-fault law

Massachusetts is one of a handful of states that follows a no-fault law for auto accident claims. What this means is that regardless of who is at fault for the accident, the injured person’s insurance pays for medical bills and lost wages. So, even in a case where another driver crosses the center line, each motorist’s insurance company pays for their individual injuries.

You can, however, hold the at-fault driver accountable under certain circumstances:

  • If your injuries resulted in more than $2,000 in reasonable medical expenses, and/or
  • The injuries included serious, permanent disfigurement, fractured bones or loss of hearing or sight.
