  • Title VII of the Civil Rights Act of 1964. It is illegal to discriminate against someone on the basis of race, color, religion, national origin, genetics, sex or pregnancy.
  • The Equal Pay Act of 1963. It is illegal to pay men and women different wages if they perform equal work in the same workplace.
  • The Age Discrimination in Employment Act of 1967. It is illegal to discriminate against anyone aged 40 or older based on age.
  • Title I of the Americans with Disabilities Act of 1990. It is illegal to discriminate against a qualified person with a disability. Employers must also reasonably accommodate the known physical or mental limitations of an otherwise qualified individual, unless doing so would impose an undue hardship on the operation of the employer’s business.
  • Code of Massachusetts Regulations Title 804. Massachusetts employers with six or more employees cannot discriminate against current and prospective employees based on race, color, religious creed, national origin, ancestry, sex, gender identity, age, criminal record, disability, mental illness, sexual orientation, genetics, or active military. Employers in Massachusetts also must provide maternity leave to biological and adoptive parents.

Most of these laws also make it illegal to retaliate against someone who claims discrimination or participates in a discrimination investigation.

  • You belong to a protected class (race, religion, gender, age, etc.);
  • You were subjected to unwanted verbal or physical conduct;
  • The harassment was based on your protected class, and
  • The harassment was a condition of continued employment, or the harassment created an offensive, intimidating, or hostile work environment.
